1. General provisions
These Terms and Conditions ("Terms") govern the use of the website biotiful.life (the "Website") and the purchase of products offered through it. The Website is operated by SC IBEAUTY OFFICIAL SRL, registered with the Trade Register under no. J40/9907/21.06.2017, VAT no. RO34466758, with its registered office at Str. Barajul Argeș 41D, parter, of. 4, Sector 1, Bucharest, Romania ("Biotiful Life", "we", "us", "our").
The Website is dedicated exclusively to international markets outside Romania. Products ordered through the Website are delivered to the countries available at checkout; the Website does not process orders with delivery in Romania.
These Terms define the rights and obligations of the seller and of the buyer (client, consumer). Please read them carefully before using the Website. By accessing or using the Website, or by placing an order, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use the Website.
The relationship between the parties is governed, among others, by the following legal acts: Government Ordinance no. 21/1992 on consumer protection; Government Emergency Ordinance no. 34/2014 on consumer rights in contracts concluded with professionals; Law no. 363/2007 on combating unfair commercial practices; Law no. 365/2002 on electronic commerce; and Regulation (EU) 2016/679 (GDPR).
2. Products and health information
The products sold on the Website are food supplements and nutraceutical products. Food supplements should not be used as a substitute for a varied and balanced diet and a healthy lifestyle.
The information published on the Website is provided for informational purposes only and does not constitute medical advice. Our products are not intended to diagnose, treat, cure or prevent any disease. If you are pregnant, breastfeeding, taking medication or have a medical condition, please consult a qualified healthcare professional before using our products. Do not exceed the recommended daily dose and keep products out of the reach of small children.
Product images are for presentation purposes only and may differ slightly from the delivered product.
3. Placing orders
Orders can be placed by adding products to the shopping cart and following the checkout steps, where you will select the payment method and enter your contact and delivery details. Adding a product to the shopping cart without completing the order does not constitute an order and does not automatically reserve the product.
After completing your order, you can verify the order details in the confirmation email and in the order history section of your customer account.
By placing an order, you confirm that all data provided for the purchase process is correct, complete and true. We reserve the right to refuse or cancel an order for reasons including, but not limited to: product unavailability, errors in the description or price of the product, errors in your order, or suspected fraud or unauthorised transactions.
4. Prices and payment
For customers in the European Union, prices are displayed in euro (EUR) and include VAT. For other international markets, prices are displayed in the national currency of the respective country, based on the market selected or detected at checkout. The applicable price is the one displayed at the date the order is placed, regardless of subsequent price changes.
The final amount charged by your bank may differ slightly due to exchange rates or fees applied by your card issuer, over which we have no control.
For deliveries outside the European Union, the displayed prices may not include customs duties, import taxes or other local charges, which are the responsibility of the customer, unless expressly stated otherwise at checkout.
Payment is made exclusively online, by card, at checkout. We do not accept cash on delivery, bank transfer or any other payment method. You represent and warrant that you have the legal right to use the card used in connection with any purchase and that the payment information you supply is true, correct and complete. Card payments are processed through a secure payment processor; we do not store your full card details.
5. Order processing and delivery
After your order is registered, you will receive an automatic confirmation by email. Orders received by 12:00 (noon) on business days are usually processed the same day or the next business day.
The estimated delivery time is 3–7 business days from dispatch. In exceptional situations, the delivery time may be extended. When your order is shipped, you will receive an electronic confirmation containing the courier details and the tracking number.
Shipping costs are displayed at checkout and detailed in our [Shipping Policy]. Please make sure your delivery address and contact details are correct; we cannot be held responsible for delays or failed deliveries caused by incorrect or incomplete information.
6. Availability, errors and inaccuracies
We are constantly updating the products available on the Website. Products may occasionally be mispriced, described inaccurately or unavailable, and there may be delays in updating information on the Website. We reserve the right to correct any errors, inaccuracies or omissions and to change or update information at any time. If an error affects an order you have already placed, we will contact you before processing it further.
7. Right of withdrawal and returns
As a consumer, you have the right to withdraw from your purchase within 14 calendar days from the date you received the products, without giving any reason, under the conditions of GEO no. 34/2014.
For health, hygiene and food safety reasons, sealed supplements that have been unsealed after delivery lose their right of withdrawal. The full conditions and the return procedure are described in our [Return & Refund Policy], which forms an integral part of these Terms.
8. Legal guarantee of conformity
All products sold on the Website benefit from the legal guarantee of conformity, in accordance with applicable law. If you receive a damaged, defective or incorrect product, please contact us as described in the Return & Refund Policy. We aim to resolve all complaints as quickly as possible, and in any case within the legal term of 30 days.
9. Promotions and discount codes
We reserve the right to run promotional campaigns and personalised discount offers. Products already included in a promotional campaign cannot be further discounted through the use of a discount code, unless expressly stated otherwise. Where a promotion is governed by separate rules, those rules will be published on the Website and will prevail over these Terms in case of conflict.
10. Customer accounts
When you create an account on the Website, you must provide information that is accurate, complete and current. You are responsible for safeguarding your password and for all activities carried out under your account. Please notify us immediately if you become aware of any breach of security or unauthorised use of your account. We may suspend or terminate accounts used in breach of these Terms.
11. Intellectual property
The Website and its original content, features and functionality (including texts, images, logos, product names and design) are and will remain the exclusive property of Biotiful Life and its licensors, protected by copyright, trademark and other applicable laws. Our trademarks may not be used in connection with any product or service without our prior written consent.
12. Links to other websites
The Website may contain links to third-party websites or services that are not owned or controlled by us. We have no control over, and assume no responsibility for, the content, privacy policies or practices of any third-party websites. We strongly advise you to read the terms and privacy policies of any third-party website you visit.
13. Personal data protection
Personal data provided through the Website is processed in accordance with applicable data protection legislation (GDPR) and with our [Privacy Policy]. Your data will not be disclosed to third parties without your prior consent, except where necessary for the performance of the order (e.g. courier and payment service providers) or where required by law.
You benefit from the rights provided by the GDPR, including the right of access, rectification, erasure, restriction, objection and data portability. 14. Limitation of liability
To the maximum extent permitted by applicable law, Biotiful Life, its directors, employees, partners, agents, suppliers or affiliates shall not be liable for any indirect, incidental, special or consequential damages resulting from (i) your access to or use of, or inability to access or use, the Website; (ii) any conduct or content of any third party on the Website; or (iii) unauthorised access, use or alteration of your transmissions or content.
Nothing in these Terms excludes or limits our liability where such exclusion or limitation is not permitted by law, including our obligations under the legal guarantee of conformity and mandatory consumer protection rules.
15. Disclaimer
The Website is provided on an "as is" and "as available" basis. We do not warrant that the Website will function uninterrupted, secure or error-free at all times, or that any defects will be corrected immediately. This does not affect your statutory rights as a consumer.
16. Governing law and dispute resolution
These Terms are governed by Romanian law and the applicable legislation of the European Union. If you are a consumer residing in the European Union, this choice of law does not deprive you of the protection afforded by the mandatory consumer protection provisions of the law of your country of residence.
Any dispute will first be attempted to be resolved amicably — please contact us at office@biotiful.life and we will do our best to find a solution. Consumers residing in the European Union may also contact the consumer protection authority in their country of residence or seek assistance for cross-border complaints through the European Consumer Centres Network (ECC-Net) — eccnet.eu. The activity of the seller is supervised in Romania by the National Authority for Consumer Protection (ANPC) — anpc.ro. You also retain the right to address the competent courts of law.
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
17. Changes to these Terms
We reserve the right to modify or replace these Terms at any time. The version in force is the one published on the Website at the date the order is placed. If a revision is material, we will endeavour to provide reasonable prior notice. By continuing to use the Website after the revised Terms take effect, you agree to be bound by them.
